Search Warrants

 

The police and other regulatory or investigatory bodies usually attend court without notice and obtain a warrant to enter and search your property. This is done 'ex parte' which means it is done without notice to you. The first you will know about this warrant is when it is being executed at your property. 

The warrants are executed early morning, when most people are sleeping, therefore they do not know how to react. It is important to know your rights and what the search warrant allows. 

At BKP Solicitors we have a specialist team who are always prepared to attend your property in an emergency and to protect your best interests and ensure that your interests are protected. 

The warrant will usually give details of the property, what items are entitled to be seized, how many occasions the warrant allows entry into the property, who can enter the property, and the validity of the warrant and when it was granted by the court. Our Balaal Hussain Khan has successfully challenged the legality of warrants which has led in the police having to return all seized items. An example of some of the cases is as follows:

AM -v-West Yorkshire Police - Successful challenge against the legality of a search warrant issued at Bradford Magistrates Court. The Police accepted liability and our clients vehicle was dropped off to his garage by the police. 

JH -v-The Metropolitan Police  – Successful challenge against the legality of a search warrant issued at Hammersmith Magistrates Court. The Police accepted liability and all seized items including, Designer handbags, computer equipment, and financial documents were all returned to our client. Our client was also paid compensation and we recovered our legal costs.

JN -v-West Yorkshire Police – Successful challenge against the legality of a search warrant issued at Bradford Magistrates Court. The Police accepted liability and all seized items including, computers, significant financial documents and Significant cash were all returned to our client. Our client was also paid compensation and we recovered our costs in Full.

 

PACE Interviews

Our team specialises in providing advice and representation to clients nationally 24 hours a day. If you are aware that the police are wanting to speak to you, we can contact the relevant department and arrange for the interview to be conducted on a voluntary basis where possible. 

If this is not possible, then we will arrange a convenient time for you to surrender yourself to the police to be interviewed for the offence. We can obtain pre interview disclosure before the interview and have a private consultation with you prior to the interview taking place

We regularly advice clients subject to investigations by the Police, NCA, RSPCA, HMRC. We also represent clients who are being investigated by regulatory bodies.  

Terrorism

Any arrest under the Terrorism Act will naturally be an extremely stressful and worrying time for you, your family and loved ones.

 

As this is a specialist area in which not many solicitors have experience you must ensure that you are represented by a solicitor with a team that has strong capabilities and genuine experience. He graduated with a LLM Masters in Terrorism and has since dealt with several Terrorism cases and is known as an expert in Terrorism cases on the Northern Court Circuit.
